Sinclaire’s Diamond Membership Plan Terms and Conditions
1. PAYMENT TERMS:
- The Customer authorizes Sinclaire Enterprises Inc., DBA Sinclaire Home Services (“Sinclaire”), to charge their credit card on file monthly for the agreed twelve (12) month term. Upon completion of the initial twelve (12) month term, the Plan will automatically renew for an additional twelve (12) month term unless terminated by either Sinclaire or the Customer.
- Sinclaire and the Customer each reserve the right to terminate the Plan at any time. In the event of early termination by the Customer, the remaining balance of the current twelve (12) month term will become immediately due and will be charged to the credit card on file.
2. CREDIT CARD AUTHORIZATION AND EXPIRATION:
- The Customer agrees to maintain a valid credit card on file throughout the duration of the Plan.
- If the credit card on file expires or becomes invalid, the Customer must provide updated payment information within thirty (30) days. Failure to do so will result in termination of the Plan, with the remaining balance for the twelve (12) month term becoming immediately due. A final invoice for the outstanding amount will be issued to the Customer.
3. PLAN BENEFITS AND COVERAGE:
- The Plan includes annual maintenance services for home heating and air conditioning equipment, along with exclusive discounts on additional services and repairs.
- Specific services covered under the Plan are detailed in the provided service documentation and may be subject to change at Sinclaire’s discretion, with appropriate notice provided to the Customer.
4. CANCELLATION POLICY:
- The Customer may cancel the Plan at any time; however, any remaining balance for the current twelve (12) month term will become immediately due and will be charged in full.
- Sinclaire reserves the right to terminate the Plan due to non-payment, fraudulent activity, or violation of these terms.
5. LIABILITY, WARRANTY, AND SERVICE LIMITATIONS:
- Sinclaire shall not be liable for any failure or delay in service due to circumstances beyond its reasonable control.
- Warranty valid on parts and labor paid for while a member of the Diamond Plan. 2‐year service warranty window starts from day of service/repair and 3-year installation window starts from completion of your full HVAC System installation. Membership must remain active to qualify for warranty. If membership does not remain active, our standard 1‐year warranty will apply.
- Emergency service defined as a situation where damage to the home could occur or occupant has health issue. Emergency service provided during normal business hours.
- The Plan does not cover repairs or services outside the specified membership agreement unless otherwise stated.
6. DISCOUNTS & OFFERS:
- Cannot be combined with other offers. Best offer will be applied.
7. ACKNOWLEDGMENT AND ACCEPTANCE:
- By signing the Plan invoice, the Customer acknowledges that they have read, understood, and agreed to the terms outlined in this agreement. The Customer further authorizes Sinclaire to charge their credit card on file according to these terms.
This agreement constitutes a legally binding contract. Failure to comply with the outlined terms may result in collection actions in accordance with applicable laws.
